III. Scope of data processing
We process your data only to the extent necessary for the purpose of providing a functional and user-friendly online presence or a functional and user-friendly website and app, and for providing our content and services. Failure to provide the data may have legal disadvantages, such as making it impossible to perform a contract. In the course of data processing, we use various third-party providers in the areas of hosting, online marketing, mailing services and customer/data management (CRM), which process data on our behalf. Where these third parties act as processors, we have concluded corresponding data processing agreements with them to ensure that an adequate level of data protection is also guaranteed by our processors (Art. 28 GDPR).
We use Lovable Labs Incorporated, 1111b South Governors Avenue, Dover, DE 19904, USA (hereinafter "Lovable") to host our service. When you visit our website, Lovable records various log files, including your IP address. Details can be found in Lovable's privacy policy at https://lovable.dev/privacy.
The use of Lovable is based on Art. 6(1)(f) GDPR. We have a legitimate interest in ensuring that our website is displayed as reliably as possible. Where corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TDDDG, insofar as the consent covers the storage of cookies or access to information on the user's terminal device (e.g. device fingerprinting) within the meaning of the TDDDG. The provider is based in the USA. Data transfers to the USA are based on the European Commission's Standard Contractual Clauses (Implementing Decision (EU) 2021/914, Module 2). We have concluded a data processing agreement (DPA) with Lovable in accordance with Art. 28 GDPR.

We have taken technical and organisational measures to ensure that data protection regulations are observed both by us and by external service providers. For security reasons and to protect the transmission of confidential content, such as content you send to us as the website operator, our website uses SSL or TLS encryption.

3. Contacting us
If you write to us, e.g. by sending us an email or contacting us via the contact form, we store the contact details you provide, such as your name, address, mobile number and email address, as well as the information provided in your enquiry.
If you contact us in the context of an existing contractual relationship or contact us in advance for information about our range of services or other services, the data and information you provide will be processed for the purpose of handling and responding to your enquiry on the legal basis of Art. 6(1), first sentence, point (b) GDPR. If you have consented to processing for the purpose of responding to your enquiry, the legal basis is Art. 6(1), first sentence, point (a) GDPR. 4. Newsletter
Our newsletter informs you about us and our offerings. Only your email address and name are required to subscribe to the newsletter. When you register for the newsletter, your email address is transmitted to us (or our email provider) and stored there. After registering, you will receive an email asking you to confirm your subscription ("double opt-in"). In this context, we (or our email provider) process the following data:

5. Processing of data of suppliers and construction companies
We collect data from suppliers and construction companies in various ways during registration, tendering, orders, deliveries, invoicing, payments and accounting. On the suppliers' side, data is processed for dispatch software, fleet management, customer management and accounting, as well as other systems for creating delivery tickets and invoices. On the construction companies' side, data is processed for internal construction management systems, the comstruct Field-App, the comstruct Web-App, accounting, customer and supplier management (purchasing and sales), and employee management. The legal basis for this processing is Article 6(1)(b) GDPR, as the data is required for the correct use of the app and thus for the performance of the contract.

8. Job applications
If you apply for a position with us, we process the information and personal data you provide for the purpose of handling the application procedure. This data includes your name, email address, address and telephone number, age, professional history, qualifications, country of residence, language skills and any other personal information you provide during your interaction with us. We may also ask you for additional information to assist us in our recruitment process and, if you are offered a position, for information such as your date of birth and employment documents. Processing may also take place electronically. This is particularly the case if an applicant sends us the relevant application documents electronically, for example by email.
We process your personal data to fulfil our contractual or pre-contractual obligations (on the legal basis of Article 6(1), first sentence, point (b) GDPR) or, where applicable, to carry out the employment relationship with you (Section 26 BDSG). If we do not enter into an employment contract with the applicant, the application documents will be automatically deleted two months after notification of the rejection decision, provided that no other legitimate interests prevent deletion. Another legitimate interest in this sense is, for example, an obligation to provide evidence in proceedings under the German General Equal Treatment Act (AGG).
